To place an order, the Customer must
a) Make his/her registration by providing the requested information, including Address, Telephone Contact, E-mail;
b) Complete the information and choose the options that are made available to him/her during the check-out process (delivery and invoicing address; shipping method; payment method)
The Customer may send his/her order through the purchasing process referred to on the aforementioned website as “confirm”, after having used the online device, by selecting “Add to shopping cart” from the online catalogue provided.
Sending of the order by the Customer is equivalent to full and complete acceptance of the prices and description of the products available for sale, as well as the general sales conditions, that shall be the only ones solely applicable to the contract thus concluded.
Mercado da Madeira will respect and execute the orders received online only up to the limits of the available stocks; in the event of a specific product not being available, Mercado da Madeira shall undertake to inform the customer accordingly, as soon as possible.
Mercado da Madeira will not be held responsible for any computer problems on the website.
The delivery of the orders will be carried out through the Mercado da Madeira services or by third parties contracted by the latter, the cost of the delivery charges being included in the final price.
The products bought shall be delivered, except in case of running out of stock within a maximum period of 45 days.
The aforementioned period shall start on the day following the date of receipt of payment.
Should the products bought cease to be manufactured or distributed, Mercado da Madeira will inform the buyer through the contacts made available by the buyer and will allow the exchange for other products of an equal value. Should the customer not wish to do so, the amount paid shall be refunded.
If the order is not delivered due to a cause that results of buyer´s fault, Mercado da Madeira reserves the right to charge the full amount of the order and take possession of the product that should have been delivered.

Mercado da Madeira offers its customers the following payment methods:
ATM – You have 5 days after placing the order to pay at an ATM (cash machine) or through home banking, using the details provided in your order confirmation (entity/reference/value) and sent to the registration e-mail address. These data are also saved in the customer account under “orders”. If, after the 5th day, the respective payment is not made, the order will be cancelled.
Bank transfer (in this case, the customer should send a copy of the bank transfer to the e-mail: firstname.lastname@example.org indicating the order number.
The payment to be made by the Customer will consist of the value of the products ordered, plus shipping costs, when applicable.
The products ordered will only be shipped after due receipt of payment and proper collection of the same.
Mercado da Madeira will make each and every effort to ensure maximum confidentiality and security in data transmitted over the internet.
The prices of the products shall be given in euros, include VAT at the prevailing rate, as well as transport and delivery costs, unless special requests for transport and delivery are made.
Additional transport, delivery and postal charges, as well as any other costs, which cannot be reasonably calculated before the date of conclusion of the contract, may be additionally payable.
Any product bought from www.mercadodamadeira.com is guaranteed, unless otherwise stated, for a period of 2 years, as provided by Decree Law No. 67/2003 of 8 April.
CANCELLATIONS, EXCHANGES AND RETURNS
The following terms and conditions shall be only applicable to purchases made on www.mercadodamadeira.pt
Under the terms and provisions set forth by Decree Law 7/2004 of January 7 (as amended by Decree Law 62/2009 of March 10 and Law 46/2012 of August 29), regarding e-commerce, Mercado da Madeira reserves the right to unilaterally cancel an order in the event of a programming error or malfunction of Mercado da Madeira’s computers, as well as in the event that the contract proposal shall arrive altered at its destination and the error concerns an essential clause of the contract.
The Customer has the right to terminate the contract without incurring any costs whatsoever within 14 (fourteen) days from the day following the day: (i) when the Customer or a third party indicated by the Customer other than the carrier takes possession of the goods or in the case (ii) when the Customer or a third party indicated by the Customer other than the carrier acquires physical possession of the last good when the consumer has ordered several goods in a single order and they are delivered separately.
In order to exercise his/her right of free termination, the Customer must communicate to Mercado da Madeira services through the e-mail address email@example.com, his/her decision to terminate this contract by means of an unequivocal statement (e.g. letter sent by post, fax or e-mail).
If the Customer so wishes, he/she also has the option of filling out and submitting the free termination form (available on this page). If he/she makes use of this possibility, Mercado da Madeira will send to the Client, within 24 (twenty four) hours, an e-mail or letter confirming receipt of the termination request.
For the period of free termination to be observed, it is sufficient that your communication regarding the exercise of the right of free termination is sent to Mercado da Madeira before the expiration of the termination period.
Unless otherwise indicated by the customer, and with a view to speeding up the refund process, the amount to be refunded will be available in the customer’s account on the website www.mercadodamadeira.pt.
Should the customer wish the money back, if the payment has been made by Credit Card, Multibanco with the indication of the associated NIB/IBAN or MB WAY with indication of associated mobile phone number, the refund will be made for the same means of payment. In the case of amounts paid by ATM without indicating the associated NIB/IBAN, the refund will be made by transfer to the IBAN indicated by the customer.
Should the customer require another form of reimbursement, he/she must contact Mercado da Madeira within a maximum period of 7 days from the date Mercado da Madeira was informed of the decision to terminate such contract.
Mercado da Madeira hereby informs that it may withhold the reimbursement until it has received the returned goods.
The customer must return the goods, without undue delay and within a period of 14 (fourteen) days from the day he/she informed Mercado da Madeira of the free termination of the contract, the same being considered as having been complied with if the customer returns the goods prior to the expiration of this 14 (fourteen) day period.
The Customer shall bear all the costs deriving from returning the goods in case the right of free termination of the contract is exercised. In the case of returning goods that, by their nature, cannot normally be returned by post, the Customer shall bear the direct costs of said return which are associated with the shipping costs that shall appear in the order shipping cost table.
Mercado da Madeira shall not accept any returns sent with postage paid or cash on delivery.
If the customer wishes to exchange items, he/she should contact Mercado da Madeira through the e-mail address firstname.lastname@example.org, or by telephone: 255 868 380 Time: 9 a.m. to 12 p.m. – 1.30 p.m. to 6 p.m. (Monday to Friday), which will provide the customer with all necessary information about the exchange process.
The Customer should not, under any circumstances, send the articles to Mercado da Madeira without having established prior contact, as these will not be received.
Although returns/exchanges are accepted within the 14-day cooling-off period (as described above), returned goods will only be accepted if they scrupulously comply with the following conditions:
A return and refund will only be admitted if the product is undamaged, sent in its original packaging, sealed (without having been opened or the original seal having been broken) and does not show any sign of use or usage, i.e., in perfect and saleable conditions;
You will have to return the article together with its packaging, manuals and accessories in immaculate, pristine conditions;
Together with the returned goods, you must enclose the invoice for such article.
All the materials received by carrier must be checked upon delivery by the customer, verifying the good condition of the product and confirming the model received, and mentioning in the carrier’s delivery note any damage found and proceed to refuse said order, by immediately informing Mercado da Madeira via e-mail. No further complaints will be accepted unless these have been mentioned at the time of receipt.
If it is not possible to check the package in the presence of the Driver / Freight Forwarder, the order must be marked “SUBJECT TO CHECK”!
All items will be checked upon arrival at our facilities and only those that comply with the conditions for return will be accepted for exchange or return.
In the event that you have received defective items or items with technical problems, Mercado da Madeira will schedule their collection at the location indicated by you, in the same dispatch area as the original order, without any charges to the Customer.
Items sent free of charge, in the form of gifts or bonuses, will not be refunded.
